Welcome to Trembola. These Terms of Service (“Terms”) govern your access to and use of the Trembola website, online store, and any services we provide (collectively, the “Services”). By browsing our website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Introduction
Trembola is an online retailer of heels and sandals operating from Ban Xop Lau, Muong Ai, Ky Son, Nghe An, Vietnam. These Terms form a binding legal agreement between you (the “Customer”, “you”, “your”) and Trembola (“we”, “us”, “our”). We may update these Terms from time to time; the version in force on the date of your order is the one that applies to that order.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By placing an order you confirm that you have the legal capacity to enter into a binding contract and that the payment details you submit are your own or that you are authorised to use them. Orders from minors must be placed by a parent or legal guardian.
3. Account registration
You may choose to create an account to track orders, save addresses and review purchase history. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Please notify us immediately at [email protected] if you suspect any unauthorised use. We may suspend or terminate accounts that show evidence of fraud, abuse, or repeated breach of these Terms.
4. Orders and order acceptance
An order placed through our website is an offer by you to purchase the products listed in the cart. Our acceptance of that offer — and the formation of a binding contract — happens only when we send you a written order confirmation by email. We may decline an order at our discretion, for example where a product is out of stock, where a pricing or description error has occurred, or where we suspect fraud. If we decline an order that has already been paid, we will refund you in full to the original payment method.
5. Pricing and payment
All prices are shown in the currency selected in our currency switcher (USD, EUR or GBP) and include any applicable indirect taxes for the displayed jurisdiction unless otherwise stated. Shipping fees, customs duties and import taxes (where applicable) are calculated separately at checkout or borne by the recipient on delivery, as set out in our Shipping Policy.
We accept Visa, Mastercard, American Express, PayPal and Stripe-supported payment methods. Payment is captured at the time the order is placed. If a payment is declined, the order will not be processed until a successful payment is received.
Prices may change at any time and promotional discounts may be withdrawn without notice. Once an order is confirmed, the price you paid is the price you paid — later price changes do not entitle you to a refund of the difference.
6. Shipping and delivery
Shipping times, methods, rates and coverage are described in our Shipping Policy, which forms part of these Terms. We will make reasonable efforts to dispatch within the timeframes published on the relevant product page, but delivery dates given are estimates and not guarantees.
7. Risk of loss and title
Title and risk of loss in the products pass to you on the moment of delivery to the address you provided at checkout. From that point you are responsible for the safekeeping of the products, subject to your statutory consumer rights and our Refund & Return Policy.
8. Intellectual property
The Trembola name, logo, product designs, product photography, copy and the layout of this website are owned by Trembola or licensed to us, and are protected by intellectual property laws. You may not copy, modify, redistribute, frame or scrape any part of the Services for commercial use without our prior written consent. Personal, non-commercial use (such as sharing a product photo on a personal social media account) is welcome.
9. User content
If you submit a product review, photograph, comment or other material, you grant Trembola a non-exclusive, royalty-free, perpetual, worldwide licence to use, edit and display that material in connection with the Services and our marketing. You warrant that any content you submit is your own, accurate, and does not infringe a third party’s rights. We reserve the right to remove user content that is unlawful, abusive, off-topic or otherwise inconsistent with the spirit of an honest customer-review community.
10. Prohibited uses
- Reselling our products commercially without a written wholesale agreement;
- Using the Services to send spam, malware, or unauthorised marketing;
- Attempting to access accounts, data or systems you are not authorised to access;
- Reverse engineering, scraping or systematically copying our content;
- Submitting fraudulent payment details or chargebacks;
- Any use that violates applicable law.
11. Disclaimers and warranties
The Services are provided on an “as is” and “as available” basis. We make reasonable efforts to ensure that product descriptions, images and prices are accurate, but small variations in colour or dimensions are inherent to handmade and natural-material products and do not constitute a defect. We expressly disclaim any implied warranties not required by your local consumer-protection law.
Nothing in these Terms limits your statutory rights as a consumer, including any non-excludable warranties under applicable law.
12. Limitation of liability
To the maximum extent permitted by law, Trembola’s total aggregate liability arising out of or in connection with any order shall not exceed the amount you paid for that order. We are not liable for indirect, incidental, special or consequential losses, including but not limited to loss of profit, loss of opportunity, or pure economic loss. Nothing in this clause limits liability for death, personal injury caused by our negligence, fraud, or any liability that cannot be excluded by law.
13. Indemnification
You agree to indemnify and hold Trembola harmless against any third-party claims, losses, damages, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any third party’s rights.
14. Governing law
These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to its conflict-of-laws provisions. Mandatory consumer-protection rules of your country of residence continue to apply where they would otherwise override this clause.
15. Dispute resolution
Most issues are resolved quickly by emailing us at [email protected]. Where a dispute cannot be resolved informally within 30 days, the parties agree to attempt mediation in good faith before commencing legal proceedings. Disputes that proceed to court shall be brought in the competent courts of Vietnam, subject to any non-waivable consumer-protection forum rights you may have at home.
16. Changes to these Terms
We may amend these Terms from time to time. The “Last updated” date at the top of this page reflects the current version. Material changes will be highlighted at the top of the page for at least 30 days following publication. Continued use of the Services after a change has been published constitutes acceptance of the revised Terms.
